Salvemonos is actively working on legal strategies that can help prevent wildlife electrocution and accidents.

Researching the state of wildlife and its environment from a legal perspective and analyzing the current legislation is crucial to create public policies and legal reforms that benefit the protection and conservation of biodiversity and animal welfare.

These are the current legal projects that Salvemonos is working on:

 

  • Bill

ADDITION OF A NEW ARTICLE 31BIS TO THE ORGANIC LAW OF THE ENVIRONMENT, N° 7554 OF OCTOBER 04, 1995. LAW TO GUARANTEE WILDLIFE CROSSINGS IN INFRASTRUCTURE

 

This initiative was proposed by the Frente Amplio party and was possible thanks to data provided by SalveMonos.

  • Lawsuit

Within the framework of the strategic litigation, the lawyer WALTER BRENES SOTO filed (based on the information provided by SalveMonos) a lawsuit to the Contentious-Administrative Court against the COOPERATIVE OF RURAL ELECTRIFICATION OF GUANACASTE R.L., the NATIONAL SYSTEM OF AREA OF CONSERVATION (SINAC ) and the state.

The claims in the lawsuit are:

  • To declare administrative responsibility for environmental damages caused by the electrocutions of wildlife.
  • The immediate implementation and installation of protection devices by the electrical companies in order to eliminate and prevent the electrocution of wildlife in the North Pacific coastal sector.

  • Legal Subcommittee

The “Commission for the Prevention and Attention of Fauna Electrocutions, with special emphasis on the Howler Monkey”, was created through the resolution ACT-OR-DR-037-2021 due to the serious ecological damage caused by electrocutions of fauna, especially of the Howler monkey as a species indicator (ACT Resolution 037, 2021).

The Commission is formed by:
1. IAR International Rescue
2. Coopeguanacaste R.L.
3. UNED, Santa Cruz Headquarters
4. Municipality of Carrillo
5. Municipality of Santa Cruz
6. Municipality of Nicoya
7. ICE
8. SalveMonos (acts under the coordination of the Tempisque Conservation Area).

On January 7th, 2022, a Subcommittee on Legal Affairs was created, with the purpose of identifying, within the applicable legal framework, the regulatory modifications (regulations, reforms, bills, etc.) that are required to prevent and mitigate the environmental affectation caused by electrocutions.

The coordination of the Subcommission is led by SalveMonos representatives.

 

  • Regulatory Plans

Regulatory plans are an instrument of territorial ordering that abides by the principle of sustainable development and have become a legal instrument with suitability and relevance for the protection and conservation of wildlife.

We support and promote the development and implementation of regulatory plans and we will be part of the Committee to be soon formed to create a Regulatory Plan in Carrillo, Guanacaste.
